Raise (collectively, “Ian Martin Group of Companies”, and the words “we”, “us” and “our” refer to Raise) respects the privacy of our employees, our suppliers and our clients and ensures that the personal information we collect about or on behalf of the aforementioned remains secure and protected and is only used and disclosed in accordance with our privacy policy and applicable laws.

This policy, which applies to access to and use of websites that have a URL that includes the raiserecruiting.com or raise.jobs domain name, including, without limitation, www.raiserecruiting.com, www.raise.jobs, apply.raise.jobs, training.raise.jobs, raise.team and support.raise.jobs, and websites that have a URL that includes the livehire.com domain name (the “Website”) and all associated services (collectively, the “Online Services”), is designed to ensure our collection, use, disclosure, retention and destruction of personal information (collectively, “Handling” and by extension, “Handle”) in conjunction with this Website meets or exceeds the requirements of applicable federal, provincial, or state privacy laws (“Privacy Laws”). We are committed to constant self-evaluation of our practices and procedures and to maintaining the highest standard in this regard.

By accessing the Website, you hereby consent to the Handling of your personal information as described in this Privacy Policy.

If you are less than the age of majority in the province, territory, or state in which you reside, you must have one of your parents or legal guardians review this Privacy Policy and agree to all its terms and conditions on your behalf. We do not knowingly retain any personal information about any individual under the age of 16 years of age and, to the extent permitted to do so by applicable laws, we will securely delete such information from our systems upon being requested to do so by a parent or legal guardian. This Privacy Policy may be amended at any given time regarding modifications to the Website, applicable laws and/or the services offered through the Website. Notice of any such modification will be provided in the change tracker of this Privacy Policy by way of an amended Effective Date. You are therefore invited to periodically access this Privacy Policy and make note of the Effective Date to determine whether changes have been made since you last reviewed it. Processing Personal Information

Complying with legal obligations: We process your Personal Information when cooperating with public and government authorities, courts or regulators in accordance with our legal obligations under applicable laws to the extent this requires the processing or disclosure of Personal Information to protect our rights or is necessary for our legitimate interest in protecting against misuse or abuse of our websites, protecting personal property or safety, pursuing remedies available to us and limiting our damages, complying with judicial proceedings, court orders or legal processes or to respond to lawful requests.

Reviewing compliance with applicable usage terms: We process your Personal Information to review compliance with our contract with you or your organization (where applicable) to the extent that it is in our legitimate interest to ensure adherence to the relevant terms; and

Other purposes: We will process your Personal Information for other purposes about which we notify you in advance, or for which we receive your consent.

Definitions and interpretation

Data: Collectively all information that you submit to Raise via our websites, emails or contractor portals. This definition incorporates, where applicable, the definitions provided in the European Union’s 2018 General Data Protection Regulation (GDPR);

Cookies: A small text file may be placed on your computer by our websites and portals when you visit certain parts of our websites and/or when you use certain features of contractor portals.

UK and EU Cookie Law: the Privacy and Electronic Communications (EC Directive) Regulations 2003 as amended by the Privacy and Electronic Communications (EC Directive) (Amendment) Regulations 2011 and the European Union’s 2018 General Data Protection Regulation;

Websites: the websites that you are currently using such as https://raiserecruiting.com/  and any sub-domains of this sites unless expressly excluded by their own terms and conditions.

In this privacy policy, unless the context requires a different interpretation:

  • the singular includes the plural and vice versa;
  • references to sub-clauses, clauses, schedules or appendices are to sub-clauses, clauses, schedules or appendices of this privacy policy;
  • a reference to a person includes firms, companies, government entities, trusts and partnerships;
  • “including” is understood to mean “including without limitation”;
  • reference to any statutory provision includes any modification or amendment of it;

Collection of Personal Information You Provide To Us

We collect various types of information from individuals who access the Website or use Online Services, including some personal information.  Personal information is collected to facilitate the hiring process, manage employment relationships, provide Online Services and to allow us to make continuous improvements to our user experience.

Personal Information we may collect include, but are not limited to:

  • Contact Information: This includes full name, address, email address, and phone number.
  • Identification Verification Information: This may include Social Security number (or equivalent national identification number), passport, driver’s license, or other government-issued identification details.
  • Application & Qualification Information: Including Resumes, references, specific application information.
  • Payroll Information: Current and historical payrolling & banking information, including business banking and invoice information for Independent Consultants.
  • Background Check Information: Authorization to conduct background checks, including criminal history, credit history, and employment verification.
  • Legal Authorization: Documentation related to the candidate’s eligibility to work in the country, such as work permits or visas.
  • Benefits Enrollment: For where it applies, information required for enrollment in employee benefits programs, such as health insurance, retirement plans, and other perks.
  • Emergency Contact Information: Contact details for individuals to be notified in case of emergency.
  • Demographic Information: Optional demographic information such as gender, race, ethnicity, and veteran status, which may be collected for affirmative action or diversity initiatives.

Job Alerts 

If you sign up for our “Job Alerts” service, you will be asked to provide personal information such as your name, e-mail address and general industry of interest regarding employment or contract opportunities.

We may combine or aggregate any of the personal information we collect through access to the Website and/or use of the Online Services, offline, or elsewhere for any of these purposes.

Information We Collect Automatically

As is true of most websites, when you visit our sites or interact with our emails, we gather certain technical information from your browser or device automatically and store it in log files. In some (but not all) countries, including countries in the European Economic Area (“EEA”), UK and Switzerland, this information is considered Personal Information under data protection laws. To the extent that this automatically collected data includes, or is linked to, Personal Information, we will treat the data in accordance with this Privacy Policy.

Assistance Request 

If you seek our assistance regarding your search for employment or contract opportunities, you will be asked to provide personal information such as your name, e-mail address and general industry of interest, and level of experience in your field. You will also have the option of asking questions as part of your request for assistance through completion of the relevant webform on the Website, in which you may choose to provide additional personal information about yourself. You are also provided with the option of uploading your résumé.

Feedback and Inquiries 

The Website may provide users with the ability to provide comments and feedback and ask questions about Raise and its operations as well as the Website and Online Services. If you include your personal information in such communications, it will be Handled in accordance with this Privacy Policy.

User Communications 

When you send e-mail or other communications to Raise, we will use your contact information and whatever other information is provided in your communication for the purposes of our review, processing, redirection, escalation, and response to your comments or inquiries. These can include e-mails sent by you via the “Contact Us” feature to make inquiries or report abuse on the Website or to solicit our services.

By using our services, you acknowledge and consent to the use of AI technologies as described in this privacy policy. Sharing of Personal Information

Corporations within the Raise may share your personal information between themselves. Please note that certain corporations within the Raise are located and operate outside of Canada including, without limitation, the United States, Ghana, Philippines and India. Raise will not share your personal information with any other third-party except in the following circumstances:

  1. With trusted third-party service providers that we have retained that require access to your personal information to perform the services for us. These may include services in terms of the hosting, operation, and/or maintenance of the Website (including any service or feature of the Website), customer service, the undertaking of customer satisfaction surveys or with respect to other operational, marketing, financial, or technical matters;
  2. To business partners that may deliver marketing communications, promotional materials, or advertisements that may be of interest to you;
  3. To carry out our staffing services, that is, to try to find job matches for applicants and fulfill staffing service requests of prospective employers.
  4. With other third parties to whom such disclosure has been authorized through your consent;
  5. Where disclosure is required by law;
  6. Where disclosure is permitted pursuant to Privacy Laws;
  7. Where disclosure is required for the undertaking of investigations regarding possible violations of the Website’s terms of use, and to prevent fraudulent activities and/or improper behaviour;
  8. In conjunction with any outsourcing of our operations or business processes (or the repatriation of the foregoing);
  9. In conjunction with any sale of Raise or any of the corporations which form Raise, or any of their respective businesses or parts of their respective businesses; or
  10. In conjunction with any litigation or other legal proceedings.

 

In all such circumstances, Raise will ensure that safeguards are in place regarding such third parties:

(i) to restrict use and further disclosure of personal information by such third parties to what is reasonably required to give effect to the purposes outlined above; and

(ii) to prevent unauthorized access to as well as unauthorized alteration, disclosure and/or disclosure of personal information.

Storage of Personal Information

Your personal information is kept on secure servers owned and operated by third-party service providers retained by Raise, some of which are retained on a global scale. We may transfer your personal information outside of Canada to prospective employers located in other countries to the extent that you have requested job placement in such foreign jurisdictions. 

Security

We maintain certain databases which include personal information. Only Raise Staff members who need to access personal information to perform a specific job-related task (for example, a placement representative or a customer service representative) are granted access to personally identifying information.

While reasonable safeguards and security measures are in place to prevent against unauthorized use, access, or disclosure of your personal information, we cannot guarantee that such safeguards are impenetrable from breaches. You assume the risk of unauthorized use, access, or disclosure of your personal information that may occur as a result of transmission over public or other networks over which we have no control.

Retention and Safeguards

Raise will retain personal information until the purpose for which such personal information was collected has been realized. There may be circumstances, however, where personal information may be retained beyond such time frame, including, without limitation, where the underlying records are the subject of litigation or potential litigation or where a longer retention period is required by or otherwise permitted by applicable laws. For example, employment standards legislation requires minimum retention period for information relating to certain employee and employment related information. Third-party suppliers have been instructed to follow the same guidelines.

Personal Information may be retained for longer periods of time in the event of any complaint, investigation or legal proceedings for purposes associated with or ancillary to the foregoing. Personal Information will also be retained for such periods of time as may be required by applicable laws.

While in our possession or under our control, personal information will continue to be subject to the security safeguards described above.  Personal information (and records that include personal information, and media on which personal information) which is scheduled to be destroyed in accordance with our record retention policy or otherwise as required by applicable laws, will be done so in a secure and permanent manner.

Accuracy

Raise will make every effort to ensure personal information remains current and is updated internally and through our third-party service providers in a timely manner. Individuals are expected to notify us in terms of any changes to their personal information and provide us with updated information in a timely manner.  We reserve the right to validate the identity of any individual requesting that their personal information be updated, and we further reserve the right to validate the accuracy of the changes proposed by such individual.

Openness 

Individuals should be aware that Raise is an international organization. As such, we have recruiters who will potentially be contacting you from our various locations in Canada, United States of America, India, Ghana, Peru and the Philippines. Each of these locations abide by all our security protocols for personal information.

Individual Access

Raise will disclose to an individual what personal information it holds related to them, along with the use and sharing of any such personal information.

Should Raise not be able or willing to comply with the request for a justifiable reason, that reason will be given to the requestor. These may include any of the following reasons:

  • The information is protected by solicitor-client privilege
  • Disclosure would reveal confidential commercial information
  • The information relates to an investigation into the breach of an agreement or of a law of Canada or a province
  • The information was generated in the course of a formal dispute resolution process

The foregoing list is not exhaustive and other reasons may be considered justifiable.

Where out of pocket costs are incurred in regard to the processing of a request, we may seek reimbursement of such expenses from the requesting party where permitted to do so under Privacy Laws. We would inform the requesting party of any such costs prior to these being incurred.

We reserve the right to validate the identity of any individual requesting delivery of their personal information or otherwise requiring details of personal information held about them.

Your Privacy Rights

As a contractor and employee, and depending on your location, your jurisdiction, and subject to applicable law, you may have the rights below regarding the Personal Information we control about you. We will respond to your requests within the appropriate timeline under applicable law.

The right of access: You have the right to request that we disclose what Personal Information we have collected, used and disclosed about you.

The right to erasure: You have the right to request that we delete Personal Information collected or maintained by us, subject to certain exceptions.

The right to rectification: You have the right to request that Raise correct any information you believe is inaccurate. You also have the right to request Raise to complete the information you believe is incomplete.

The right to restrict processing: You have the right to request that Raise restrict the processing of your personal data, under certain conditions.

The right to object to processing: You have the right to object to Raise processing your personal data, under certain conditions.

The right to data portability: You have the right to request that Raise transfer the data that we have collected to another organization, or directly to you, under certain conditions.

The right to non-discrimination: You will not receive any discriminatory treatment when you exercise one of your privacy rights.

You can also ask us to correct or update your Personal Information; object to the processing of your personal information; ask us to restrict processing of your Personal Information or request the portability of your Personal Information. Again, you can exercise these rights by contacting the Privacy Officer.
